% 17.02.2016 Bail Appln. 2449/2015 & Crl. M. (B) 8102/2015 This is an application under Section 438 Cr.PC moved by the petitioner for grant of anticipatory bail in case FIR No. 701/2015 under Section 308/341/34 IPC registered at Police Station Amar Colony.
Counsel for the petitioner submits that pursuant to the directions given by this Court, he has already joined the investigation and is still ready and willing to further join the investigation.
Learned Additional Public Prosecutor for the State does not dispute this fact that he has already joined the investigation. Furthermore, it is stated that although in the initial FIR, the complainant had stated that the petitioner along with his two -three other associates came, stopped and slapped him and his associates caught hold of his hand, then he gave danda blow on his head whereas his associates gave him leg and fist blows as a result, he sustained injuries, however, after filing of this complaint, when his statement was recorded under Section 161 Cr.PC to know about the associates, complainant stated that he does not know whether Sachin had come with other friends or not. He heard on the next day from other persons that Sachin Singh Rawat was
accompanied by other associates. The injured was discharged from the hospital on the same day and the injury was opined to be simple Keeping in view the totality of the facts and circumstances of the case, it is ordered that in the event of his arrest:- (v) Petitioner be admitted to bail on his executing personal bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand only) with one surety in the like amount to the satisfaction of the concerned I.O./SHO. (vi) He shall join the investigation as and when called for by the I.O. (vii) He shall furnish his address as well as his contact number to the Investigating Officer.
(viii) He shall not threaten or coerce complainant or any prosecution witness. The applications is accordingly disposed of.
