O R D E R

% 13.01.2017 IA No. 9289/2016 & IA No. 429/2017

1. IA No. 9289 of 2016 is an application filed by the Applicant, Mr. Rajiv Khosla, Wing Commander (Retired) acting on behalf of as many as 38 others seeking a direction that 'the allottees and owners of the Farm Units as per Annexure to this application be made a party to the suit jointly with the Air Force Naval Housing Board and independently to protect their interests."

2. The said application in the context of arbitration that has already been taken place between the Petitioner and the Respondent and in which an award has already been passed.

3. The second application, IA No. 429 of 2017, is for a direction that the copy of the said Award be made available to the applicant.

4. This Court had on 26th September 2016 already expressed the view that IA 9289 of 2016 in the present form cannot be entertained. Nevertheless the Court had provided to the applicant the services of a lawyer from the panel of Delhi High Court Legal Service Committee (DHCLSC).

5. Pursuant thereto, Mr. Vivek B. Saharya, counsel appeared. Mr. Saharya informs the Court that he had advised the applicant that in the present form the applications are not maintainable and the Applicant should seek to work out the remedies against Air Force Naval Housing Board in other appropriate proceedings.

6. The Court has also conveyed to the Applicant who appeared in person that the remedies lie elsewhere. These applications cannot be entertained and are dismissed as such.
