O R D E R

% 14.09.2017 Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. It is submitted that petitioner had filed a writ petition being W. P. (Civil) No.5206/2015 alleging herein that though he was a permanent member of the Raman Vihar Cooperative Group Housing Society, his name did not figure in the list of members. He raised a grievance that management of the society had illegally inducted certain persons as tenants against the bylaws of the society. Complainant was also a member but he was expelled in the year 2013. The complainant is no more a member now. Complainant thinks that petitioner was instrumental in his explanation, therefore, has lodged false FIR with the allegations that petitioner had taken out one paper containing signatures of the complainant and certain other persons from the records of the Registrar, Cooperative Societies, Delhi and attached it with the letter written to RCS, for appointing

the Inquiry Officer.

It is submitted that file is available in the office of Registrar Cooperative Societies and Investigating Officer can very well verify the documents from there. The petitioner has been granted interim protection by this Court on 29th January, 2016 which is still continuing. Keeping in mind the totality of facts and circumstances, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `10,000/-( Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.

Bail application is disposed of in the above terms. Dasti.
