Mr. Ashok Gurnani, the learned counsel for the appellant/nonapplicant accepts notice. This application seeks release of the occupation charges deposited by the non-applicant for the period of occupation till its vacation. The property has since been vacated and handed over to the applicant/respondent No.1. Mr. Ashok Gurnani, the learned counsel for the non-applicant, submits that the non-applicant has no objection to the aforesaid amount being released to the applicant.

Accordingly, the application is allowed.

Let the said amount deposited in the Court alongwith interest accrued thereon be released to the applicant/respondent No.1-Mr. Sudhir Saran Bhatnagar.
