% 22.03.2016 I.A. No.3833/2016 (u/o XXIII R.1 CPC, by petitioner) and Arb. P. No.609/2015 & I.A. No.23660/2015 The abovementioned application has been filed by the petitioner under Order XXIII Rule 1 CPC seeking to withdraw the present petition. It is stated in the application that the disputes between the parties have been resolved. The terms and conditions of the settlement are mentioned in the Settlement Agreement dated 30th January, 2016 which is annexed as Annexure-A along with the said application. The said Settlement Agreement is duly signed by the parties. The parties shall be bound by the terms and conditions of the settlement.

In view of the settlement, the petitioner wishes to withdraw the present petition. As prayed, the same is dismissed as withdrawn. The date

already fixed as 3rd May, 2016 stands cancelled. The matter be not listed on the said date. Pending application also stands disposed of. I.A. No.3833/2016 is disposed of.
