% 21.01.2016 Respondent has been served. He has put in appearance. There are two suits pending inter se the parties. Admittedly, the parties are same. One suit is filed by the non-applicant/respondent which is a suit for injunction pending before the Civil Judge, Karkardooma. This suit was filed in the first instance. The second suit for possession has been filed by the petitioner and is pending before the Additional District Judge at Tis Hazari Courts. It is stated that since the parties are the same and the property is also the same, to avoid conflict of judgment it would be appropriate that both the suits should be decided by a same Court.
Accordingly, the suit i.e. CS No.501/2007 titled Gurmeet Singh Vs. Sardar Kashmir Singh and Ors. pending before the Civil Judge, Karkardooma be transferred to the Court of Additional District Judge,
Tis Hazari where the suit i.e. CS No.292/2012 titled Kashmir Kaur Vs. Gurmeet Singh is pending. This would be in the interest of both the parties.
Parties to appear before the Court of Senior Civil Judge, Karkardooma to transfer the suit pending before the Court to the Tis Hazari Court on 08.02.2016.
Petition disposed of.
