% 07.01.2016 The present application has been filed under Section 439 Cr.P.C. for the grant of regular bail of the accused/petitioner Shahid in Sessions Case No.71/2014, FIR No.543/2010, under Sections 395/ 397/411/414/506/120-B/34 IPC, Police Station Mandawali. The case of the petitioner is that the petitioner had been regularly appearing before the Trial Court but he could not appear on 15.09.2015. On that day, prosecution witness Smt. Rama (PW2) was present and on account of absence of the accused/petitioner, NBW was issued against the accused/petitioner and notice was issued to his surety.
Thereafter, the accused appeared before the Court on
22.09.2015 and since then he is in custody.
Notice of the present bail application was given to the State. I have heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. Learned APP for the State has submitted that the other accused are also absconding and proclamation proceedings are pending against them and if the present accused/petitioner is released on bail, he is also likely to abscond from appearing in the Trial Court. Perusal of file shows that the FIR in the present case was registered in the year 2010 and the trial is continuing. In the facts and circumstances, the accused/petitioner is hereby ordered to be released on bail on furnishing the personal bond in the sum of Rs.50,000/- with two sureties in the like amount to the satisfaction of the Trial Court.
The bail application is accordingly disposed of. Dasti.
