% 19.02.2016 After some hearing, learned counsel for the petitioners submits that two aspects have not been gone into and examined by the tribunal; i) the respondent had suffered a penalty and sealed cover procedure had been followed and ii) the respondent's representation against the ACR grading for the year 2002-2003 is still pending and not disposed of. Learned counsel for the petitioners seeks permission to withdraw the present writ petition with liberty to file a review application before the tribunal. The writ petition is dismissed as withdrawn with liberty as prayed for. It is clarified that we have not made any observations on merits. In case of an adverse order, the petitioner if so advised, would be entitled to file a fresh writ petition.
