O R D E R

% 26.10.2016 Mr. Vinay Gupta, learned counsel appearing on behalf of the respondentcompany states that the parties have arrived at an amicable resolution of the underlying dispute and the terms and conditions of the settlement are enshrined in the MOU dated 27th September, 2016, which has been placed on record. Mr. Vinay Gupta, learned counsel, further states that the said MOU dated 27th September, 2016 has been acted upon and payments therein have already been made to the petitioner. Learned counsel undertakes that the respondent company shall pay the remaining instalments in terms of said MOU, as per the dates prescribed in the said MOU, without demur. The undertaking furnished on behalf of the respondent company is hereby accepted.

Mr. Sanjay Mishra, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition, in view of the circumstance that the parties have settled the underlying dispute by way of the said MOU dated 27th September, 2016 and in view of the undertaking given on behalf of the respondent company.

Leave granted.
