1. Despite service of notice none has appeared for the Respondent during the three hearings since 10th May, 2016.

2. The Respondent is proceeded ex parte.

3. The assertion of the Petitioners that there exists an arbitration clause in the agreement between the parties remains uncontroverted.

4. The Court, accordingly, appoints Ms. Kavita Jha, Advocate (Mob. No. 9818174307) as sole Arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. The learned Arbitrator will proceed in terms of the Arbitration and Conciliation Act, 1996 as amended with effect from 23rd October 2015. The learned Arbitrator will fix her own fees and terms and communicate it to the parties. The Petitioner will appear before the learned Arbitrator on 18th November 2016 at 4 pm at

a venue to be organised by the Petitioner. The fees and expenses of the arbitrator will be shared by the parties equally. The Arbitrator will proceed in the matter after service of notice on the Respondent.

5. The petition is disposed of. A copy of this order be communicated to the learned Arbitrator forthwith.
