versus COMMISSIONER OF POLICE & ORS.

CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 14.11.2019 1.
The petitioner has filed the present petition, inter alia, seeking several prayers. However, the petitioner submits that the petitioner's essential grievance is that she is aggrieved by the action of the police authorities, restraining her from carrying out her activities as a street vendor in the area of Lajpat Nagar, Delhi.
2.
Concededly, the said area has been declared as a street vending free area. This court is also informed that orders have been passed by this Court directing the concerned authorities to ensure that street vendors are removed from the said area.
3.
At this stage, the learned counsel appearing for the petitioner states that the petitioner's grievance also stems from the fact that she and certain
other street vendors have been singled out by the police authorities. She states that whilst the petitioner and some other vendors have been removed, other vendors operating in the area have not been disturbed. 4.
She submits that action by the police authorities should be uniform and all street vendors in a zone should be removed, if they are not permitted to operate in the particular zone. The aforesaid contention is merited. 5.
Accordingly, respondent nos. 1 and 3 are directed to ensure that the policy for removal of street vendors from certain zones are implemented fairly and uniformly.
6.
The petitioner would be at liberty to point out the names and details of the vendors who continue to carry out their activities in the area in question (the area from which the petitioner has been removed), to the concerned authorities.
In case such names and details are provided, the concerned authorities shall take such steps as warranted, in accordance with law. 7.
In view of the limited grievance, no further orders are required to be passed in this petition. The same is disposed of. The pending application is also disposed of.
