% 08.03.2019 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2-Chhote Lal S/o Sh. Bhagau Ram is present in Court. He has produced his Aadhar Card, photocopy whereof has been placed on record at page 118. Respondent no.2 submits that he has settled the matter with petitioner of his own free will and without any undue force, pressure or coercion, inasmuch as, received entire settled amount of `12 lacs. He further submits that he has no objection in case offence under Section 138 of the Negotiable Instruments Act, 1881 (for short the 'NI Act') is permitted to be compounded. Affidavit of respondent no.2 is also on record to this effect at pages 109 and 110.
He has identified his signatures at points 'X' of his Affidavit.
In view of the compromise arrived at between the petitioner and respondent no.2 voluntarily and the fact that entire settled amount stands paid, offence under Section 138 of the NI Act is permitted to be compounded. Petitioner is acquitted. He be released from the jail, if not required in any other case.
Revision petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
