% 11.04.2019 Regular bail is sought by petitioner in FIR No. 83/2016, under Sections 376 of IPC & Section 6 of POCSO Act, registered at Police Station Sarita Vihar, Delhi.

Learned counsel for petitioner has drawn the attention of this Court to trial court's order of 16th March, 2016 vide which petitioner was granted regular bail.

It is submitted that after filing of the charge-sheet, petitioner could not appear before trial court on the date for which he was summoned as he was held up in traffic jam and an application for cancellation of nonbailable warrants was filed but the said application was dismissed by trial court order of 26th November, 2018. It is submitted that petitioner is in the custody since 26th November, 2018.

BAIL APPLN. 3096/2018

Upon hearing and on perusal of the status report, it is directed that petitioner be released on bail, subject to his furnishing bail bond in the sum of ₹10,000/- with one local surety in the like amount to the satisfaction of trial court.

This application is accordingly disposed of, while not commenting upon the merits of this case.
