% 02.02.2016 The present bail application has been filed under Section 439 of the Code of Criminal Procedure for grant of bail in the case arising out of FIR No.37/2013 registered by Police Station Harsh Vihar under Sections 374/397/307/34 of the Indian Penal Code and Section 27 of Arms Act.
The petitioner is stated to be behind the bar since 18th March, 2013.
During the course of arguments, it has been submitted by learned counsel for the petitioner that the star witnesses of the case have not been examined by the prosecution so far and now the matter is fixed for 11th February, 2016 in the Court below. Learned counsel
for the petitioner further submits that he may be given liberty to move the application after the examination of witnesses. After hearing learned counsel for the parties, it is made clear that if the star witnesses are not present on 11th February, 2016, the Trial Court shall summon the star witnesses namely Jaivir & Sonu, on the next date of hearing.
On completion of examination, the petitioner would be at liberty to move the fresh application for bail. This bail application is dismissed accordingly. P.S.TEJI, J FEBRUARY 02, 2016 aa
