1. The present petition under Section 438 CrPC seeks pre-arrest bail in FIR No.
418/2016 dated 9th July, 2018, P.S.
Alipur under Section 420/448/506/34 IPC.
2. Issue notice. Learned APP appearing for the State accepts notice and seeks and is granted three weeks' time to file reply/status report.
3. Subject to the Petitioner reporting to the Investigating Officer at P.S. Alipur on 5th January, 2019 at 4 pm and on all subsequent dates as required by the Investigating officer, no coercive action be taken against him till the next date of hearing.
4. It is made clear that the Petitioner will not try to contact any of the prosecution witness or hamper the investigation in any manner. He will also not leave the NCR without prior permission from this Court.
5. Learned counsel appearing for the Petitioner states that the accused would handover to the IO the original/certified copy of the Agreement to Sell executed between the accused and Mr. Manoj Aggarwal and all the original documents pertaining to the property in question that are in his power and possession. He further states that the accused would also give his specimen signatures to the Investigating Officer in order to assist him in the investigation. Let him do so when he appears before the Investigating Officer on 5th January, 2019.
