O R D E R

% 05.08.2016 The petitioner before this Court seeks a prayer that entries qua the khasra i.e. khasra No. 38, 40 & 41 forming part of village Mandawali, Fazalpur Illaqa Shahdara be effected in favour of the petitioner as the petitioner is in cultivator and physical possession of the said land.

Learned counsel for the respondents on advance notice has put in appearance. He has drawn attention of this Court to a Notification duly published in Gazette of India dated 24.08.1974 S.O. 2190 pursuant to which the said land has become urbanized and the

mention of village Mandawali, Fazalpur is at serial No. 40 of the aforenoted Notification.

Learned counsel for the respondents under instructions from the patwari (present in Court) submits that in this view of the matter, this writ petition is no longer maintainable. A copy of this Notification has been handed over to the learned counsel for the petitioner. At this stage, learned counsel for the petitioner submits that she is withdrawing this writ petition but the writ petition may be treated as representation to the Department who shall answer the same in accordance with law within an outer limit of three months. Petition disposed of.
