FAO(OS) 634/2015 & CM 27094/2015(stay) We have heard the learned counsel for the parties. The Section 9 petition is yet to be disposed of by the learned Single Judge. The next date fixed in the matter before the learned Single Judge is 19.02.2016.
We are informed by the learned counsel for the respondent that the date for submitting the financial bids has been extended to 21.12.2015.
The learned counsel for the appellant requests that the matter be heard and disposed of before that date so that no future complications arise. The learned counsel for the respondent has no objection to the same.
Consequently, we are disposing of this appeal with liberty to the parties to approach the learned Single Judge for an earlier date of hearing, prior to 21.12.2015. We hope that when such an application is made, the learned Single Judge would accede to that request. The early hearing application can be moved by either party. The learned counsel for the respondent submits that some time may also be given prior to the hearing, for filing the rejoinder/affidavit. We think that two weeks' time would be sufficient for that purpose.
The appeal stands disposed of.
