% 01.08.2016 The above mentioned petition was filed under Section 9 of the Arbitration & Conciliation Act, 1996 for seeking interim order which was granted on 16th November, 2015 wherein encashment of the bank guarantees No.316020524059-GP, 316020524031-GP and 316020524022-GP was stayed. The said order was continued from time to time. Learned counsel for the respondent No.1 has informed that Arbitral Tribunal has been constituted and the respondent No.1 has no objection if the present petition be treated as an application under Section 17 of the Act by the Arbitral Tribunal.
Under these circumstances, the interim order passed on 16th November, 2015 to continue, subject to the condition that the petitioner will
keep the bank guarantees alive.
Copies of the pleadings of the present petition will be filed by the petitioner within three weeks before the Arbitral Tribunal who is requested to dispose of the same at an early date. The petition is disposed of accordingly. Dasti. MANMOHAN SINGH, J.
