The appellant has filed the present appeal impugning a judgment dated 03.09.2015, whereby the appellant and his co-accused (Md. Sarvar) were convicted of an offence under Section 21(c) of the Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act). Both the accused were sentenced to serve ten years of rigorous imprisonment. The appellant also impugns an order dated 07.09.2015, whereby the appellant and the coaccused were sentenced to rigorous imprisonment for a period of ten years and a fine of ₹1 lakh. The co-accused (Md. Sarvar) had also preferred an appeal (bearing no.Crl.A.191/2016 captioned Md. Sarvar v. State). The said appeal was allowed by an order dated 24.02.2020. 2.

For the reasons stated in the judgment dated 24.02.2020 in Crl.A.191/2016 captioned Md. Sarvar v. State, the present appeal is

allowed. The appellant be released forthwith if he is not required in any other case.
