O R D E R

% 23.11.2015 By order dated 2.5.2015 the competent authority granted furlough to the petitioner for a period of two weeks to be counted from the date of his release subject to certain conditions of furnishing bond, maintaining good behaviour during the period of furlough and surrendering before the jail authorities on time.

The aforesaid order could not be effected for the reason that one of the co-accused of the petitioner, who is his cousin, jumped the furlough and did not surrender before the jail authorities. The present petition has been filed on the strength of an order dated 5.10.2015 passed by this Court whereby another co-accused Sajid Wasim @ Raja was released on furlough for a period of two weeks despite the fact that the person, who has jumped the furlough and had not returned to the jail,

was his own brother.

It has been submitted on behalf of the petitioner that aforesaid Sajid Wasim @ Raja, who was released on furlough by an order of this Court has surrendered before the jail authorities on completion of the time of furlough period.

It is further argued, with reference to the nominal roll, that the overall conduct of the petitioner has been satisfactory. Considering the aforesaid facts, it is directed that the petitioner be allowed to be released on furlough in accordance with the order dated 2.5.2015 on the same terms and conditions. The petitioner shall display good behaviour during the period of furlough and shall surrender before the Superintendent of Central Jail, Tis Hazari on the expiry of furlough period. He shall, visit the Police Station under which his place of residence falls, during the period of his release on furlough at least once a week preferably on Fridays.

With these observations, the petition is disposed of. A copy of this order be communicated to the Superintendent of the concerned Jail for information and compliance. ASHUTOSH KUMAR, J NOVEMBER 23, 2015 ns
