O R D E R

% 06.01.2016 The petitioner is seeking parole for the purpose of filing SLP against dismissal of his appeal which has been dismissed by this Court on 10.08.2015.

Notice had been accepted by counsel for the State on the last date. Status report has been filed.

The nominal roll of the petitioner reflects that as on date he has undergone incarceration of about 5 years which includes remissions earned by him. He is a convict under sections 376/506 of the IPC. The maximum sentence awarded to him is RI for a period of 7 years. His jail conduct has been satisfactory.

The status report filed by the State has verified the address of the appellant at Ghar Bakor, Post Bakor Bia Skpur PS Supol, District Supol, Bihar where his mother is stated to be residing. His mother is

stated to be suffering from various ailments as well. Statement of the neighbours to the said effect has been recorded. Noting the above factual matrix, the petitioner is granted parole for a period of three weeks (to be counted from the date of his release) on his furnishing a personal bond in the sum of Rs.10,000/- with one surety of like amount subject to the satisfaction of the Jail Superintendant with condition that the petitioner shall appear before the local SHO on every Monday of week in this intervening period. He will not come in contact with the victim or her family. Needless to state that he shall surrender to the Jail Authorities on expiry of the aforesaid period of three weeks.

Petition disposed of.

Copy of the order be sent to the jail superintendent for intimation to the appellant.
