% 10.09.2018 After some hearing the learned counsel, on instructions of the petitioner who is present in person, seeks permission to withdraw the present petition and the application filed therewith, she reserving her right to seek necessary relief towards the "right to evidence" against the first respondent (husband) by appropriate proceedings.
The petition and the application filed therewith are dismissed as withdrawn.
The counsel for the second respondent at this stage submitted that since the petitioner has withdrawn the present petition, she (the petitioner) to be asked to vacate the subject premises.
For enforcement of an order to such effect, the party concerned will have to take out appropriate proceedings before the executing forum.
