% 21.12.2016 On the complaint of respondent no. 2, present FIR No. 16/2015 under Section 420 IPC was registered at Police Station Sarita Vihar against the petitioner. It is submitted that petitioner and respondent no. 2 have settled their disputes vide a Memorandum of Understanding dated 11th November, 2015. Respondent no. 2 is present in Court along with his counsel and has been identified by SI Nagender Naagar, P.S. Sarita Vihar. He admits having settled the matter with the petitioner vide aforesaid Memorandum of Understanding.
Respondent no. 2 further submits that he has already
received the possession of janta flats bearing nos. D-601 & 605, Ground Floor, Pocket 11, DDA Janta Flats, Jasola Vihar, New Delhi. Respondent no. 2 further submits that he has settled the matter with the petitioner of his own free will and without any undue force, pressure and coercion and is not willing to pursue the FIR any further.
Keeping in mind the nature of disputes and that parties have settled their disputes, inasmuch as respondent no. 2 does not wish to pursue the FIR any further, in the interest of justice, FIR No. 16/2015 under Section 420 IPC registered at Police Station Sarita Vihar and the consequent proceedings emanating therefrom are quashed.
