For the reasons given therein, the application is allowed. FAQ 411/2015 and CM No.28832/2015 (stay) 4.

Admittedly, the appellant, has not, as yet, filed an application under Order 39 Rule 4 of the CPC for vacating the stay. Mr. Sharma says that the needful will be done within one week from today. 6.

Accordingly, the appeal and the pending application are disposed of, with a direction to the trial court to dispose of the application, if any, filed by the appellant under Order 39 Rule 4 of the CPC for vacation of the stay order, no later than two weeks from the date of filing of the application by the appellant. 7.

In order to facilitate the aforesaid exercise, the counsels and their respective parties will appear before the trial court on
