% 22.07.2016 Arbitral Tribunal has been constituted as admitted by the parties. In view of Section 9(3) it is mandatory that once the arbitral tribunal has been constituted, the Court shall not entertain an application under sub-Section (1), the Court shall not entertain the petition. Learned counsel for the respondent very fairly submits that order passed on 2nd December, 2015 may continue during the arbitration proceedings.

However, liberty be granted to move an application in view of change of circumstances, if any, for modification/ vacation of the said interim order. In view of the above, the interim order granted on 2nd December, 2015 is made absolute. Liberty as sought is granted. The petition is disposed of accordingly.
