O R D E R

% 26.02.2016 Bail Appln. 2494/2015 Counsel for the petitioner submits that the matter has been settled between the parties for a sum of Rs. 3,70,000/-, out of which, a sum of Rs. 3,00,000/- has been paid by the petitioner to the complainant.

As per the last order dated 18.12.2015, a sum of Rs. 70,000/- was to be paid positively on or before the next date i.e. today. Till date, the said amount has not been today. Even today, the petitioner has not brought the said amount by stating that due to financial difficulties, he has not brought the said amount and he has brought only Rs. 20,000/-.

Petitioner cannot be allowed to act on his own whims and fancies. On the last date, it was made clear to him that no further extension shall be granted to him. Since he is not abiding by the terms and conditions, the interim protection granted to him on 20.11.2015 and extended till date stands vacated.

Petitioner is present in the Court. He be taken in custody. The application for anticipatory bail is accordingly dismissed. SUNITA GUPTA, J FEBRUARY 26, 2016 rs Now, counsel for the petitioner states that petitioner be granted time till 4:00 pm to arrange the amount.

As such, let the matter be taken in post lunch session. SUNITA GUPTA, J FEBRUARY 26, 2016 rs Present as before. Complainant is also present in person. Balance amount of Rs. 70,000/- has been paid to the complainant in cash. Complainant has brought three cheques for a sum of Rs. 2,00,000/-, Rs. 1,00,000/- & Rs.20,000/- respectively. All the three cheques have been returned to the petitioner. Photocopy of three cheques be kept on record. Earlier order is recalled. The interim protection granted to the petitioner vide order dated 20.11.2015 is confirmed and in the event of arrest, appellant be released on bail on furnishing bail bond in the sum of Rs. 15,000/- with one surety of the like amount to the satisfaction of Investigating Officer/SHO concerned. He is further directed to appear before the Investigating Officer of the case on 29.02.2016 at 4:00 pm and thereafter as and when summoned by the Investigating Officer.

Application stands disposed of.
