O R D E R

% 27.04.2017 EA(OS) No.111/2017 (under O.XXIII R.3 CPC) The present application under Order XXIII Rule 3 CPC has been instituted jointly on behalf of the parties to the accompanying execution petition. The application has been signed by the parties as well as their respective counsels and is duly supported by affidavits of Mr.Satinder Punn and Mr.Hardeep Singh, on behalf of the decree holder as well as the Judgement Debtor, respectively.

It has been agreed by and between the parties that the judgement and decree dated 27th March, 2014, which has attained finality in all respects will be complied with in terms of two collaboration agreements both dated 23rd December, 2016, annexed to the present application as Annexure A collectively. The compromise deed dated 28th January, 2017, by and between the parties is annexed to the present application as Annexure B and exhibited as C-1.

The agreement between the parties is lawful and the same is taken on record. The parties shall abide by the terms and conditions of the said compromise deed dated 28th January, 2017, without demur.

In view of the compromise arrived at between the parties as aforesaid, learned counsel appearing on behalf of the decree holder seeks leave to withdraw the present petition.

Leave granted.

Consequently, the accompanying petition is dismissed as withdrawn and disposed of accordingly.

Pending applications, if any, also stand disposed of.
