% 07.01.2016 IA No. 215/2016 (under Sec. 151 CPC r/w Sec.27 of the Arbitration Act for summoning witnesses, by plaintiff) Instant application has been filed by the petitioner seeking permission to summon its witnesses, as mentioned in para 4 thereof, before the ld. Arbitrator for 19/02/2016 and 25/02/2016. It is informed by learned counsel for the petitioner these witnesses were earlier allowed to be summoned for 10/12/2015 but the witnesses did not turn up on the said date and hence the present application.

Ld. counsel for respondent accepts formal notice of this IA and submits that he has no objection if the same is allowed.

Accordingly, this application is allowed and let the witness at Sr. No.1 be summoned with record for 19/02/2016 at 3:00 PM and witnesses at Sr. Nos. 2 to 4 be summoned with record for 25/02/2016 at 3:00 PM, for their evidence before the ld. Arbitrator, on taking steps within two weeks from today and on filing of PF duly specifying the time, details and particulars, of the ld. Arbitrator before whom the witness are supposed to depose. This IA stands disposed off accordingly.
