This winding up petition is filed pointing out that there are unpaid dues of Rs.6,30,478/- plus interest.

After some arguments, learned senior counsel for the respondent in the peculiar facts and circumstances of the case and without prejudice to the rights and contentions submits that the amount being small the respondent company would not like to contest the matter. He has agreed that the said amount would be refunded with simple interest @ 8% per annum w.e.f. the date of deposit. He further submits that the payment shall be made to the petitioner within four weeks from today.

In view of the above, learned counsel for the petitioner withdraws the present petition. Payment of the said amount, as noted above, shall be in full and final settlement of the claim of the petitioner including the claim which is said to be pending before the Consumer Disputes Redressal Forum-VI, (District New Delhi).

Learned senior counsel for the respondent states that pursuant to

interim orders passed by the Appellate Forum - VI some amount also stands deposited with the Forum. He submits that the respondent shall on making necessary payments to the petitioner, as above, shall be entitled to refund of the said amount which is deposited with the Forum. 5.

In view of the above, learned counsel for the petitioner seeks to withdraw the present petition with liberty to seek revival of the present petition in the event there is a default on the part of the respondent. 6.

Petition is dismissed as withdrawn. All pending applications, if any, stand disposed of.
