O R D E R

% 07.08.2018 The present petition is predicated on the assertion that, the petitioner was entitled to a reimbursement in the amount of Rs. 14,22,820/-, along with interest thereon, in accordance with law and that the respondents have only disbursed a sum of Rs. 10,06,666/- which is in violation of the directions issued by this Court by way of order 20.02.2007, affirmed by a Division Bench of this Court vide order dated 07.09.2007.

On the contrary, Ms. Monika, learned CGSC appearing on behalf of respondent nos. 1 and 2 states that, in compliance with the directions issued by this Hon'ble Court, they have disbursed the reimbursement claim of the petitioner strictly in terms of the CGHS scheme and rules and consequently, there is no warrant for initiation

of contempt proceedings against the respondents for violation of the directions contained in the afore-stated order. While reviewing the above position, Mr. S.K. Bhaduri, learned counsel appearing on behalf of the petitioners states that he seeks leave to withdraw this Contempt Petition with liberty to initiate proper proceedings, in accordance with law, in relation to the disputed amount, which has not been disbursed by the respondents, in relation to his claim for reimbursement.

The Petition is disposed of accordingly.
