% 28.03.2016 The petition came up for hearing for the first time on 20.11.2015 when this court, while issuing the notice to the respondent/complainant, directed the petitioner to deposit a sum of Rs.3 lacs within a week instead of Rs.5 lacs as was to be deposited in the form of FDR in the court of learned CMM (South) in compliance of the Order dated 12.10.2015.

Thereafter no steps were taken by the petitioner either with respect to deposit of amount or for issuance of notice to the respondent/complainant.

The matter then came up for hearing on 09.03.2016 when there was no appearance on behalf of the petitioner and the court in the interest of justice passed no adverse order.

Today again, there is no appearance on behalf of the petitioner despite second call.

The petitioner does not seem to be interested in prosecuting the matter.

Dismissed as withdrawn for non prosecution.
