MA No. 17090/2015 (Exemption) The present is a petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 seeking a direction to the respondent to enlarge the petitioner on parole in order to enable him to arrange, organize and remain present at the marriage of his daughter scheduled for 31st January, 2016.
It is an admitted position that such a specific request has not been made to the competent authority of the respondent as yet. In view of the foregoing, Mr. Ankur Bansal, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present writ petition with liberty to approach the competent authority in this behalf in the first instance. Leave and liberty granted.
The present writ petition and the application are dismissed as withdrawn and disposed of accordingly.
However, in view of the exigency of the situation, in the event the application for parole is filed before the competent authority on behalf of the
petitioner within a period of two days from today, the same shall be disposed of by the competent authority in accordance with law within a period of seven working days thereafter, under intimation to the petitioner. Dasti.
