O R D E R

% 08.03.2016 Learned counsel for the petitioners has submitted that vide order dated 18th August, 2015, on account of non-appearance of the accused, the non-bailable warrants (NBW) were issued against the absentee/accused.

Aggrieved by the same, the present petition has been filed.

The arguments advanced by learned counsel for the petitioners is that on that date, the application for exemption was moved which was declined by the learned Court below and NBW were issued and thereafter the present petition has been filed. On the other hand, learned APP for the State submits that if any accused is absent from the Court, the option with the Court is only to issue non-bailable warrants.

In the facts and circumstances, this Court is of the considered opinion that ends of justice would be secured if the petitioners are directed to appear before the Court below and file fresh bail bond. Consequently, the present petition is disposed of with costs of Rs.5,000/- to be paid to the Delhi High Court Legal Services Committee, with the direction that the petitioners shall appear before the Court below within a period of one week from today and furnish two surety bonds for a sum of Rs.50,000/- each to the satisfaction of the Court below.
