% 24.01.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 10th November, 2009 passed in RSA No. 109/2008 and the undertaking given in W.P.(C) 8128/2012.

Since the order passed in RSA No. 109/2008 is an order passed in a proceeding which is a continuation of a suit, this Court is of the view that petitioner has an alternate effective remedy by filing execution proceedings. Consequently, present contempt petition is disposed of with liberty to file execution proceedings in accordance with law. However, it is clarified that this Court has not expressed any opinion on the merits of the controversy. The rights and contentions of all parties are left open. MANMOHAN, J JANUARY 24, 2017 rn
