The petitioner seeks regular / interim bail in case FIR No.1136/2014 registered under Sections 307/34 IPC and 25/27/54/59 Arms Act at PS Rajouri Garden. Status report and medical report are on record.

I have heard the learned counsel for the parties and have examined the file.

It is submitted that the petitioner is in custody since 17.09.2014. Statement of the complainant has since been recorded. The petitioner is suffering from various ailments.

Bail is opposed by the complainant.

On perusal of the record, it reveals that the petitioner along with his associate is facing trial under Section 307 IPC. He has been specifically named in the FIR.

While appearing as PW-5, the complainant has implicated the appellant to be one of the assailants who had inflicted injuries to him with sword. The victim had sustained injuries 'dangerous' in nature and had to be operated upon. The injuries were caused on the vital organ i.e. abdomen. MLC on record reveals that multiple stab wounds were inflicted on various body organs of the victim by sharp weapon.

Medical report on record reveals that the petitioner is getting regular treatment for the ailment from which he is suffering. His general condition is satisfactory and vitals are within normal limits. He has been provided treatment as prescribed by jail dispensary as well as outside hospitals. It is relevant to note that the petitioner was granted interim bail by the Trial Court earlier from 28.05.2015 to 27.08.2015 for the said purpose.

Considering the gravity and seriousness of the offence, no sufficient ground for grant of regular / interim bail at this stage. The bail applications are dismissed.
