The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.195/2012 registered under Sections 302/120B/34 IPC and Sections 25/27 Arms Act at PS Narela. Status report is on record. 2.
I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 07.05.2012. All the material prosecution witnesses are stated to have been examined. Admittedly, eye witnesses relied upon by the prosecution who were close relatives of the deceased have not supported the prosecution. Learned APP on being asked if there was any other incriminating BAIL APPLN. 2558/2015
piece of circumstance against the petitioner merely stated that the crime weapon was recovered from the petitioner. Co-accused are stated to have been admitted to bail. It is informed that though the petitioner was involved in thirteen criminal cases, in most of them either he has been acquitted / discharged or is on bail. 3.
Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.
