O R D E R
% 20.07.2016 The present revision petition has been filed under Section 397 and 401 read with Section 482 Cr.P.C. against the judgment dated 28.09.2015 whereby the conviction of the petitioner by the Trial Court was upheld and the sentence awarded to the petitioner, while also upholding the same, was modified to the extent that instead of simple imprisonment, the petitioner was sentenced to rigorous imprisonment (RI) for a period of one year for the offence punishable under Section 304-A IPC. Other terms of sentence were maintained i.e. fine of Rs.1,00,000/- in default SI for three months and disqualification for holding commercial driving licence for a period of
one year.
I have heard the learned counsel for the parties. At the very outset, the learned counsel for the petitioner has confined his prayer to the reduction in the quantum of sentence awarded by the Trial Court and modified by the Appellate Court. In view of the given facts and circumstances of the case, the sentence awarded to the petitioner is reduced from RI for one year to RI for 8 months with rest of the terms of sentence as awarded by the Appellate Court remaining unchanged.
With these modifications, the revision petition stands disposed of.
