1. The original bank guarantee („BG‟) has been filed by the Petitioner pursuant to the order dated 21st November 2016 in a sealed cover with the Registry and copy thereof has been furnished to the Respondent.

2. The said sealed cover will be sent to the Additional Co-ordinator, Delhi International Arbitration Centre („DAC‟) by the Registry within one week from today. Thereafter any order in relation thereto can be sought by either party in the arbitral proceedings. The BG in question shall be kept renewed till further orders by the learned Arbitrator.

3. As regards query in para 4 of the order dated 10th November 2016 is O.M.P.(I) (COMM.) 17/2015

concerned, Mr. Dayan Krishnan, learned Senior counsel appearing for the Petitioner, on instructions, states that the Petitioner is not prepared to accept supply of a similar quantity in terms of the proforma invoice.

4. No further directions are called for in this petition.

5. The petition and the pending applications are disposed of in the above terms.
