% 18.05.2016 C.M.APPL. 6880/2016 The delay in filing replication is condoned. Application is disposed of. CONT.CAS(C) 171/2016 1.

Learned counsel for the respondents submits that respondent has repaired the toilet in terms of the order dated 03rd November, 2014. Learned counsel for the respondents has produced three photographs of the repaired toilet, which are taken on record. Learned counsel for respondents has handed over one key of repaired toilet to the counsel for the petitioner without prejudice to the contention that the toilet in question is a common toilet.

Learned counsel for the petitioner submits that the toilet in respect of which the respondent handed over the key is not a common toilet but a toilet in the exclusive use of the petitioner.

Learned counsel for the petitioner has handed over the key of the

alternative toilet provided by the respondent to the counsel for the respondents in the Court today.

This petition is disposed of in view of the toilet in question having been handed over by the respondent to the petitioner. The issue as to whether the toilet is a common or exclusive to the petitioner is left to be agitated by the parties before a competent Court. 5.

Copy of this order be given dasti to counsels for the parties under the signature of the Court Master.
