On the last date of hearing, learned counsel for the petitioner was requested to address the Court on the maintainability of the present petition, wherein directions have been sought to the respondents for granting him promotion to the post of Assistant Commandant w.e.f. 19th December, 2008, without first assailing the order dated 10th August, 2009, passed by the Disciplinary Authority and upheld by the Appellate Authority vide order dated 22nd April, 2010.

Today, learned counsel for the petitioner states that he may be permitted to withdraw the present petition while reserving the right of the petitioner to challenge the order dated 10th August, 2009 passed by the W.P.(C) 2152/2016

Disciplinary Authority and the order dated 22nd April, 2010 passed by the Appellate Authority, as may be permissible in law. 3.

Leave as prayed for is granted.

The petition is dismissed as withdrawn.
