This Public Interest Litigation has been filed seeking a direction for CBI investigation into the alleged scam of misappropriation of about Rs.2 Crores by the respondents for renovation of 'Bhojtal'. 2.
We have heard the petitioner appearing in person. 3.
A perusal of the material available on record show that the property in question is situated in State of Uttar Pradesh and it also appears that the proceedings initiated by the petitioner for redressal of his grievance are pending in the High Court of Allahabad. The respondent Nos.2 and 3 against whom the allegations are made are Government of Uttar Pradesh and the District Magistrate, Aligarh District, Uttar Pradesh respectively. 4.
We are, therefore, of the opinion that the present petition cannot be maintained in this Court.

Accordingly, without expressing any opinion on merits of the case, the petition is dismissed leaving it open to the petitioner to institute fresh W.P.(C) 34/2016
proceedings before the appropriate forum.
