% 23.08.2016 CM APPL. 30486/2016 (under Order 23 Rule 3 CPC) This application seeks disposal of the writ petition in terms of the Memorandum of Settlement arrived at between the parties on 16.08.2016. The application has been signed by the parties and is supported by their respective affidavits. The workman has already been paid an amount of Rs. 2.50 lakh by way of cheque No. 244000 dated 16.08.2016 which cheque has been encashed. Furthermore, the complainant has withdrawn his complaint which was pending before the Deputy Labour Commissioner. Since no lis survives in the matter, accordingly, the application is allowed and the petition is disposed off in terms of the aforesaid settlement. The date of 06.09.2016 is cancelled.
