% 04.04.2016 The petitioner has filed the present petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 for appointment of an Arbitrator. Reply is not on record. The same is lying under objection. Learned counsel for the petitioner states that the disputed amount is just Rs.30 lac and some Advocate may be appointed as sole Arbitrator. The respondent has no objection to prayer made in the petition as well as the appointment of t he Arbitrator to adjudicate the disputes between the parties. The prayer made in the petition is allowed.
Ms.Geeta Sharma, Advocate (R/o E-68, Saket, New Delhi, Mob. No.9910006702), who is present in Court, is appointed as sole Arbitrator to adjudicate the disputes between the parties as mentioned in the present petition. The parties are also allowed to file their respective claims and counter-claims before the Arbitrator.
Parties to appear before the Arbitrator on 19th April, 2016 at 3:30 pm.
The arbitration proceedings shall take place in the High Court premises itself. The Arbitrator shall ensure the compliance of the provisions of Arbitration and Conciliation (Amendment) Act, 2015 before commencing the arbitration. The fees of the learned Arbitrator is fixed at Rs.80,000/- which shall be shared by both the parties in equal proportions. The petition is accordingly disposed of.
Copy of this order be given dasti to the learned counsel for the parties and a copy thereof be delivered to the learned Arbitrator forthwith. MANMOHAN SINGH, J.
