O R D E R

% 22.04.2016 The General Manager and the Managing Director of the respondent are present, and they tender an unconditional apology to the court for violating the order.

Counsel for the parties state that they have arrived at a settlement contained in the Memorandum of Understanding dated 22.04.2016, whereunder the defendants have agreed to pay the license fee in terms of the said agreement. Counsel for the defendant states that he is carrying the cheques for the amount due, which have been tendered to counsel for the plaintiff and the same is accepted by him. Counsel for the defendant states

that the amount has been computed after deducting TDS for which certificate shall also be issued to the plaintiff in due course. The original Memorandum of Understanding entered into between the parties has been tendered in court and is taken on record. The suit stands disposed of in terms of the settlement, which shall continue to bind the parties.

Since the suit has been settled between the parties prior to the commencement of trial, the plaintiff shall be entitled to refund of 50% of the court fee.
