% 24.02.2016 This Court has been informed that the suit stands restored vide order dated 02.02.2016. Copy has been placed on record. The order dated 26.09.2015 has been challenged. Learned counsel for the petitioner submits that prima facie findings have been returned against him which could jeopardized the pleadings which have been made in the suit filed by him. His submission is that these findings be set aside and who was in the possession of the suit property be a question opened to be decided at the stage of trial. These findings being tentative in nature, it is made clear that it will not come in the way of the findings to be returned by the Trial Court who will decide this issue after permitting the parties to lead evidence.

Petition disposed of.
