% 05.05.2016 The respondent has filed the affidavit.

Counsel for the petitioner states that the said affidavit has not been filed in terms of the order passed by the Division Bench as full disclosure has not been made by the respondent.

It is the admitted position that the Arbitral Tribunal has already been constituted. The petitioner is allowed to raise the said objection before the Arbitral Tribunal. In the meanwhile, the present petition be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996. The petitioner to file the copies of pleadings before the Arbitral Tribunal within two weeks in the regard and the

same will be decided in accordance with law.

The petition is disposed of accordingly.

Copy of the order be given dasti to both the parties. MANMOHAN SINGH, J.
