The present petition has been filed by the petitioners under Article 226 of the Constitution of India read with Section 482 Cr.P.C. praying for defreezing the bank accounts of the petitioner No.1 i.e. bank account No.61214476494 with State Bank of Bikaner & Jaipur, Janak Puri Branch and bank account No.02612010000944 with Kotak Mahindra Bank, JMD Rgent Arcade, Gurgaon Branch, which were being jointly operated by the petitioners No.1 and 2.

Mr.Sanjay Lao, learned ASC for the State submits that instead of directly approaching this Court by filing the present writ petition, the petitioners should have availed their remedy before the learned Trial Court. W.P.(CRL) 2832/2015

Mr.Mukul Gupta, learned Senior Advocate for the petitioners submits that the petitioners may be permitted to withdraw this petition with liberty to avail the appropriate remedy before the concerned Court. Learned Senior Advocate for the petitioners further submits that to avoid further delay in the matter, necessary directions may be issued to the concerned Court for expeditious disposal of the application, which the petitioners shall be filing within a week before the concerned Court.

In view of the submissions made above by learned Senior Advocate for the petitioners as well as learned ASC for the State, the writ petition is dismissed as withdrawn granting liberty to the petitioners to avail their remedy before the concerned Court.

It is further directed that on filing of the application within a week by the petitioners, every effort shall be made by the concerned Court to dispose of the same within four weeks thereafter.

As prayed, copy of the order be given dasti to learned counsel for the parties.
