% 12.10.2017 I.A.No.11742/2017 Present application has been filed by the plaintiff no.4 under Order XXIII Rule 1 CPC for withdrawal of the present suit. Mr.Dilip Kumar, Advocate has also handed over another application under Order XXIII Rule 1 CPC on behalf of plaintiff nos.1 to 3 seeking withdrawal of the present suit. Registry is directed to number the same.

In view of the aforesaid applications, the present suit is

dismissed as unconditionally withdrawn.

At this stage, Mr.Vivek Sibal, learned counsel for plaintiff no.4 states that the plaintiffs shall voluntarily deposit Rs.25,000/- with the Lok Nayak Hospital, New Delhi, within a period of two weeks. The receipt of payment shall be filed with the Registry of this Court within four weeks thereafter.
