% 09.05.2016 This is an application under Section 439 Cr.P.C moved by the petitioner seeking interim bail for the purpose of admission of his children in school in case FIR No. 49/2011 u/s 302/308 IPC registered with Police Station Tilak Nagar.

Application is opposed by learned Public Prosecutor for the State on the ground that petitioner is involved in a murder case. The wife of the petitioner left the house after the arrest of the petitioner and there is no information where she has gone. However, the two children are being taken care of by their paternal uncle Harpal in the village. That being so, paternal uncle can get the children admitted in school. Moreover, as per the nominal roll, the petitioner is also involved in another FIR. His conduct is also reported unsatisfactory as he was punished for assault/use of criminal force.

Keeping in view the totality of facts and circumstances, I do not deem it appropriate to release the petitioner on interim bail. As such, application is dismissed.
