% 01.03.2016 Petitioner is aggrieved by the order dated 30.9.2015 vide which in a petition under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act).
Learned C.M.M. had noted that the objections filed by the socalled tenant in secured assets (secured with the Bank) are not to be decided in that pending petition. On the first date notice had been issued. Learned counsel for the Bank has put in appearance. Learned counsel for the Bank submits that without prejudice to the respective contentions of the parties he has no objection if the petitioner (purported tenant/occupier in the secured assets of the Bank) is given permission to file his objections and the same may in accordance with law be disposed of by the C.M.M.
The C.M.M. is accordingly, directed to dispose of the objections
which shall be filed within a period of 10 days from today. Parties are directed to appear before the C.M.M. on 21.3.2016. Status quo of the suit property (confined to the occupation of the petitioner) shall be maintained till the next date. With these directions petition disposed of.
